Artwork rights and intellectual property.
Podcentro's rules for artwork rights, trademarks, publicity rights, and reporting intellectual-property concerns.
The standard
Podcentro respects copyrights, trademarks, and other intellectual-property rights, and requires members to do the same. The Services may not be used to print or sell a product that infringes those rights or that misleads buyers about who made it. Podcentro is a production provider. It does not clear rights for you and does not insure your listings.
What you confirm when you submit a file
By uploading or emailing Content, you state that:
- You own the Content, or you have a license that covers commercial printing and sale on the products and in the countries you sell into.
- Using the Content on a product does not infringe copyright, trademark, trade dress, patent, design right, privacy, or publicity rights.
- You have paid, or will pay, any royalties or license fees your own licensors require.
- You are legally able to give Podcentro the production license described in the Terms of Service.
If you are unsure, do not send the file. Public resources such as the U.S. Copyright Office and the U.S. Patent and Trademark Office explain the categories of rights. They are not a substitute for advice about your design.
Designs that need extra care
- Trademarks and characters. Names, logos, sports marks, film and game characters, and distinctive packaging are not available to print merely because they are easy to find online. A fan reference can still be an infringement.
- People. A photograph, portrait, or name of a private person or a celebrity can raise publicity and privacy rights even when you made the image.
- Artificial intelligence and stock tools. A generator’s terms may limit commercial use, and the output can resemble a protected work. You are responsible for reading those terms and for the file you submit. Podcentro does not certify that generated art is original.
- Quotes and layouts. Short phrases are not always protected, but a copied illustration, type treatment, or full layout can be. “I changed the colors” is not a rights clearance.
Podcentro’s own property
The Podcentro name, logo, website, copy, product photography created by Podcentro, and production templates are owned by Podcentro or its licensors. You receive no ownership in them. You may not copy the site, scrape it to build a competing catalog, or present Podcentro marks as your own brand. The limited right to mention that you produce with Podcentro is described in the Terms of Service.
Mockup images Podcentro supplies for planning are for your listings of products Podcentro can make. They are not a license to use those images for unrelated goods or to imply that a third-party brand made the product.
What Podcentro may do
Podcentro may refuse a file, hold an order, or remove a listing asset from its systems when there is a credible rights concern. Podcentro does not have to produce an item while a complaint is open. Repeat or serious violations can lead to a closed account. Podcentro may also share the notice and your contact details with the complaining party and, when the law requires it, with a platform or authority.
A decision to produce a file is not a legal opinion that the file is clear. You remain responsible to the rights holder and to your Customers.
How to report a concern
Copyright complaints, including notices under the Digital Millennium Copyright Act, follow the Copyright and DMCA page. Send them to hello@podcentro.com with the subject line “Copyright notice.”
Trademark, counterfeit, or publicity complaints should use the same address with the subject line “IP notice,” and should include:
- Your name, mailing address, email, and your relationship to the right you describe.
- The mark, name, or image, and where it is registered or why you claim the right.
- The URL, order, or file name of the material on or through Podcentro.
- A short explanation of why the use is not authorized.
- A statement that you believe the notice is accurate and that you are the owner or an authorized agent.
Notices that omit these points may be returned for more information. Knowingly false notices can lead to liability and to a block on further complaints.
Your response
If your Content is challenged, Podcentro will tell you when the law and the quality of the notice allow it, using the email on your account. You may send a response that identifies the Content, explains the license or other basis for your use, and includes your contact details. A response is not automatic reinstatement. Podcentro reviews it against the original notice. Copyright counter-notices follow the DMCA page.
